TERMS OF SERVICE — VIRTUAL REALITIES (Dreamland, Margate)

By booking, entering, or participating in any Virtual Realities experience (“VR Experience”), you agree to these Terms.

1) Who We Are & What These Terms Cover
These Terms of Service (“Terms”) govern your use of the  Virtual Realities Free Roam VR Arena (the “Arena”), located within Dreamland (the “Park”). By booking, entering, or participating in an Arena session, you agree to these Terms.
If there is a conflict between these Terms and any Park terms, both apply; however, Park admission terms govern your entry and conduct in the Park, while these Terms govern your Arena booking and participation.


2) Eligibility, Age & Health Requirements
You must be 18+ to book a session for yourself or for children under 18.
All participants 18+ must sign an individual waiver agreement.
A parent or guardian (18+) must sign a waiver on behalf of participants under 18.
Minimum Age: 7 years. Participants under 14 require a parent/guardian (18+) to remain on site.
Height/Size Restrictions: Participants must meet equipment fit/safety requirements: minimum height 100cm.
Health Considerations: VR experiences may trigger motion sickness, nausea, disorientation, dizziness, anxiety, and in rare cases photosensitive seizures. Do not participate if you:
are pregnant;
have epilepsy, a history of seizures, heart conditions, severe motion sickness, balance disorders, or any condition that may be aggravated by VR;
have recent surgery, neck/back injuries, or use medical devices that could be affected (e.g., some pacemakers);
are under the influence of alcohol, drugs, or intoxicants.
For safety and hygiene, you must not participate if you (or a child under your supervision) have symptoms of a communicable illness (e.g., fever, persistent cough, vomiting/diarrhoea) or have been advised to isolate. We may refuse entry or ask you to leave if you appear unwell or fail to follow on‑site health and safety measures or signage that we reasonably implement from time to time
You must immediately inform staff of any discomfort and stop if you feel unwell.
We reserve the right to refuse participation for safety.

3) Conduct, Safety Rules & Prohibited Behaviour
To keep everyone safe:
Follow all staff instructions, safety briefings, and signage.
No running, pushing, or rough play. Maintain spatial awareness of other players and arena boundaries.
Approved footwear only: closed‑toe, flat, secure footwear; no heels, sandals, or loose footwear.
No food, drinks, gum, or vaping/smoking in the Arena.
No filming/flash photography inside the Arena unless we explicitly permit it.
No vandalism or misuse of equipment. You are responsible for wilful or negligent damage you cause.
Cleanliness & contaminants To protect equipment, do not participate if clothing, hair, or skin are covered in sand, mud, water, glitter, paint, oils, or similar substances that could damage equipment. We may refuse participation without refund in such cases.
We may remove any participant who breaches these Terms or behaves in a way that risks safety—no refund in such cases.

4) Booking, Tickets & Admission
Park Admission: Entry to the Park is separate from an Arena ticket (unless explicitly stated). Park entry fees and rules apply.
Booking Confirmation: Your booking is confirmed when we issue a confirmation email or receipt.
Arrival Time: Please arrive 15 minutes before your session for check‑in and briefing. Late arrivals may reduce session time or result in refusal of entry; no refunds for lateness.
 
Headset and equipment calibration may be required before and during your session. This may use a small portion of the scheduled time and does not entitle you to additional time or a refund.
Group/Exclusive Bookings: Group leaders must ensure all participants meet eligibility and comply with these Terms.
Gift Vouchers/Promotions: Subject to specific terms, expiry dates, and availability.

5) Instruction, Briefing & Use of Equipment
Before participating in any Virtual Realities session, all players will receive a mandatory safety briefing, gameplay explanation, and equipment‑use instruction.
This briefing is a required part of your allotted session time and helps ensure the safety and enjoyment of all participants.
You agree that:
You will follow all instructions provided by staff during the briefing and throughout the experience.
You will not be permitted to participate until the briefing is complete.
Time taken for instruction, fitting equipment, or explaining game mechanics forms part of your total booked session time and does not entitle you to extended playtime or a refund.
Failure to follow instructions may result in removal from the experience for safety reasons, without refund.
Headset and equipment calibration may be required before and during your session. This may use a small portion of the scheduled time and does not entitle you to additional time or a refund.

6) Pricing, Payment & Refunds
Prices: Displayed in GBP and inclusive of VAT as stated.
Payment: All payments are due on booking, unless agreed otherwise, and are final and non-refundable. This includes situations where the participant does not enjoy or feels dissatisfied with the VR Experience.
Accessibility Exception (Equality Act 2010):
If a participant cannot safely participate due to a disability‑related accessibility need, and Virtual Realities cannot provide a reasonable adjustment enabling participation, an alternative solution—such as rescheduling, credit, or another accommodation—may be offered at our discretion.
This is not a general right to a refund and is assessed case‑by‑case to meet legal obligations.
This policy does not affect your statutory rights (e.g., services to be performed with reasonable care and skill) and our duties to make reasonable adjustments under the Equality Act 2010.
Rescheduling Policy:
Requests to reschedule must be made at least 5 days in advance.
Rescheduling is subject to availability.
Service Disruption: If we cancel or materially curtail your session (e.g., due to technical issues), you’ll be offered a reschedule or refund for the affected portion in accordance with your statutory rights.
Your statutory rights under the Consumer Rights Act 2015 are not affected. If the service is not provided with reasonable care and skill, you may be entitled to a remedy.

7) Health & Safety Waiver and Assumption of Risk
Participation in a Virtual Realities experience involves the use of Virtual Reality equipment and free‑roam movement, which carries inherent risks such as tripping, slipping, collisions, disorientation, motion sickness, dizziness, anxiety, or discomfort.
To help ensure the safety of all guests:

7.1) Mandatory Waiver Requirement
All participants aged 18 or over must sign an individual Waiver Agreement before taking part in any session.
For any participant under the age of 18, a parent or legal guardian aged 18 or over must complete and sign a Waiver Agreement on their behalf.
A participant will not be permitted to enter the arena or engage in any activity unless the required waiver has been signed and verified.

7.2) Assumption of Risk
By participating, you acknowledge and accept that Virtual Reality activities involve inherent risks, including but not limited to:
Trips, slips, or falls
Collisions with physical objects or other participants
Motion sickness, nausea, dizziness, eye strain, or sensory overload
Disorientation during or after headset use
Emotional responses such as anxiety or panic
You voluntarily assume these risks to the extent permitted by law and agree to follow all safety instructions and briefings provided by our staff.

7.3) Safety Compliance
You agree to:
Follow all staff instructions, safety rules, and briefings
Immediately stop participation and inform staff if you feel unwell or unsafe
Not participate while under the influence of alcohol or drugs
Not participate if you have a medical condition that could make VR unsafe for you
Ensure that minors under your supervision comply with all rules
Failure to follow safety instructions may result in removal from the activity without refund.

7.4) Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud.
However, to the extent permitted by law, Virtual Realities is not responsible for:
Injuries arising from risks inherent in VR activities that you voluntarily assume
Injuries or incidents resulting from your failure to follow instructions or safety guidance
Any loss or damage caused by negligent or unsafe behaviour by you or minors under your supervision
This section must be read together with the Waiver Agreement, which forms part of your participation requirements.

7.5) Waiver validity
A signed participant waiver remains valid for 12 months and may be relied upon for repeat visits within that period, provided your details and health status remain accurate. Please tell us if anything changes.

8) Equipment, Damage & Loss
We provide VR equipment, accessories, and safety gear that must be used as instructed.
You agree to take reasonable care and not modify or tamper with equipment.
We may charge you reasonable costs for loss or damage caused by your negligent or intentional acts.
We are not responsible for your personal belongings. Lockers may be available (use at your own risk).
You are responsible for any losses, costs, or damage we reasonably incur that arise from your breach of these Terms or negligent/intentional damage to our equipment or premises (including by minors in your care). This does not affect rights that cannot be limited by law.

9) Accessibility & Adjustments
We aim to make the Arena accessible an inclusive environment for all guests, including those who are neurodivergent or have disabilities. Due to the nature of free roam VR, there may be physical movement and headset requirements. Please contact us in advance to discuss reasonable adjustments or alternative experiences. Service animals may not be able to enter the play space for safety, but staff will advise on options.

10) Alcohol, Drugs & Intoxication
We operate a strict no‑intoxication policy. If we reasonably believe you are under the influence of alcohol or drugs, we may refuse participation or remove you for safety—no refund.

11) Photos, Video & Content
Participant Recording: Personal recording may be restricted. Where allowed, ensure it does not interfere with safety or others’ privacy.
Our Recording: We may capture photos/video of the Arena area for safety, training, or marketing. We will request separate consent for using identifiable images of you in marketing.
Use of Materials: All VR software, assets, branding, and content are protected by intellectual property laws. You receive a personal, non‑transferable right to participate; no commercial use, copying, reverse engineering, or derivative works permitted.

11a) Media Consent (Marketing) and reconcile policy
We do not capture or use identifiable photos/video of you (or a minor under your care) for marketing unless you give clear, separate consent (by signing a Media Consent Form or giving recorded verbal consent). You may withdraw consent at any time by contacting support@virtualrealities.uk. Operational CCTV and non‑marketing recordings for safety/training may still occur as described in our Privacy Notice.

12) Data Protection & Privacy (UK GDPR)
We process personal data (e.g., booking details, waivers, incident reports, CCTV) as described in our Privacy Notice:  https://virtualrealities.uk/privacy-policy.
CCTV may operate for safety and security.
Legal Basis: Typically contract performance, legitimate interests (safety, security, service improvement), legal obligations, and consent where required (e.g., marketing imagery).
Your rights include access, rectification, erasure, restriction, objection, and data portability. Contact: support@virtualrealities.uk
We retain data only as long as necessary for the purposes stated.
We generally retain waiver and incident‑related records for up to 6 years (or longer if required by law or to establish/defend legal claims).

13) Third-Party Services & The Park
Your entry to and movement within Dreamland is governed by the Park’s own terms and policies : https://www.dreamland.co.uk/terms-and-conditions/.
We are not responsible for third‑party services, facilities, or transport linked to your visit.

14) Liability
We are responsible for loss or damage you suffer that is a foreseeable result of our breach of contract or failure to use reasonable care and skill.
We are not responsible for loss or damage that is not foreseeable, or that is caused by your breach of these Terms or failure to follow safety instructions.
For consumer participants, we do not exclude or limit liability where unlawful to do so, including for death or personal injury caused by our negligence.
For business bookings: our total liability (whether in contract, tort, or otherwise) is limited to the total price paid for the relevant booking, except where such limitation is prohibited by law.

15) Rescheduling & Force Majeure
We may alter, suspend, or cancel sessions due to maintenance, technical issues, staffing, safety, or events outside our control (including weather, power failure, strikes, public emergencies).
Where feasible, we will offer a reschedule or refund for the affected portion.
16) Lost Property
Items found in the Arena may be held for a reasonable period. We do not accept responsibility for lost or uncollected items.

17) Complaints & Feedback
We aim to resolve issues quickly and fairly. Please raise concerns with on‑site staff or contact us at support@virtualrealities.uk. If we cannot resolve a complaint, you may be able to use Alternative Dispute Resolution (ADR) or consumer bodies for guidance.

18) Changes to These Terms
We may update these Terms to reflect operational or legal changes. The version applicable to your booking is the version in force at the time of booking, unless a change is required by law or for safety.

19) Severability
If any part of these Terms is found invalid or unenforceable, the remaining terms will remain in effect.

20) Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. You and we both submit to the non‑exclusive jurisdiction of the courts of England and Wales.

21) Acceptance
By booking, entering, or participating in a session at the Arena, you confirm that you have read and agree to these Terms and, where applicable, that you are the parent or legal guardian providing consent for a minor participant.
